If an FIR has been registered against you

Get a copy of the FIR, note the sections invoked, and speak to a lawyer before you respond to any police notice. Whether to seek anticipatory bail, appear in response to a notice, or challenge the FIR itself depends on the sections and the facts alleged. What you do in the first few days often matters more than anything that follows.

If you are the complainant

Where the police will not register an FIR for a cognizable offence, the law provides further steps, including an application to the Superintendent of Police and a complaint before the Magistrate. I draft these so the facts and documents are on record from the start.

Bail before the High Court

When bail is refused by the Sessions Court, an application can be made to the High Court. A good bail application explains why custody is not needed: the nature of the allegations, the evidence collected, the time already spent in custody, and the conditions the accused is ready to accept.

Criminal matters move fast. For urgent bail matters, call rather than message.

Frequently asked questions

How do I apply for anticipatory bail in Lucknow?
An application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 can be filed before the Sessions Court at Lucknow or the High Court, Lucknow Bench. The court looks at the allegations, the material collected and whether custody is really needed. Read more in anticipatory bail in Uttar Pradesh.
Can an FIR be quashed by the High Court?
Yes. Under Section 528 of the BNSS the High Court can quash an FIR or criminal proceedings where the allegations do not disclose an offence, where the case is an abuse of the process of law, or, in suitable cases, where the parties have genuinely settled a largely private dispute.
The police have sent me a notice to appear. What should I do?
A notice of appearance under Section 35(3) of the BNSS (formerly Section 41A CrPC) must be taken seriously. Speak to a lawyer before you go, carry a copy of the notice, and keep a record of your appearance. Whether you also need anticipatory bail depends on the sections invoked.
Which court in Lucknow will hear my criminal case?
Trials begin before the Magistrate or the Sessions Court in the Lucknow district courts. Bail after rejection by the Sessions Court, quashing petitions, revisions and appeals go to the High Court, Lucknow Bench, which also hears matters from the other Awadh districts.
Do you take criminal matters from districts outside Lucknow?
High Court matters from the districts within the Lucknow Bench's jurisdiction, such as Barabanki, Sitapur, Hardoi, Unnao, Rae Bareli and Ayodhya, can be handled from Lucknow. See clients from across Uttar Pradesh.
