Before you buy

Many property disputes begin with a purchase made without checking the chain of title. Before you pay, the title documents, revenue records and encumbrances should be checked and the agreement reviewed. That costs far less than a suit afterwards.

When someone interferes with your property

If someone is interfering with your possession or threatening to sell disputed property, an application for a temporary injunction can preserve the position while the suit is decided. Collect every document that shows your title and possession: the sale deed, khatauni or other revenue entries, mutation orders, house tax receipts and utility bills.

Family property

Partition disputes are often best settled by a registered family settlement or partition deed. Where that is not possible, a partition suit decides each co-owner's share. Daughters have equal coparcenary rights in Hindu joint family property since the 2005 amendment to the Hindu Succession Act, 1956, a point that changes the shares in many families.

Frequently asked questions

Does mutation (dakhil kharij) make me the owner of land?
No. Mutation entries in the revenue records are mainly for revenue purposes. They do not create or extinguish title, which is decided by a civil court where it is disputed. See mutation of land in Uttar Pradesh.
How can I stop someone from building on my land?
File a suit for injunction with an application for a temporary injunction, supported by your title and possession documents. Where there is trespass or damage, a police complaint can be made at the same time.
Do daughters have a share in ancestral property?
Yes. Since the 2005 amendment to the Hindu Succession Act, 1956, daughters are coparceners with the same rights as sons. In Vineeta Sharma v. Rakesh Sharma (2020) the Supreme Court held that this applies whether or not the father was alive on 9 September 2005.
What can I do if a builder delays possession?
You can file a complaint before U.P. RERA under the Real Estate (Regulation and Development) Act, 2016, which allows a buyer to seek possession with interest for delay or a refund with interest. A consumer complaint may also be available.
What should I check before buying property in Lucknow?
The chain of title deeds, the khatauni and mutation record, encumbrances registered with the sub-registrar, the approved map, and tax and utility receipts. The sale agreement should be reviewed before any substantial payment.
